ARBOR, MI – On Wednesday, December 2nd, in a military courtroom at Camp
Pendleton, California, the government began its case against an
American warrior.&#160; They know this is their last chance to disgrace and
destroy the 22 - year career of Marine </span><span style="font-family: trebuchet ms,geneva;">LtCol Jeffrey Chessani, 
and it’s evident they are pulling out all the stops.</span>&#160; <br />
<br />
<span style="font-family: trebuchet ms,geneva;">Many of the spectators
in the small courtroom were battle-hardened Marine veterans of World
War II, Korea, and Vietnam.&#160; Some were veterans of the Korean Chosin
Reservoir battle, considered the most violent small unit fighting in
the history of American warfare.&#160; All the veterans looked on in
disbelief as government lawyers ridiculed a loyal combat officer.&#160; The
consensus among these battle-hardened veterans ─ they never would have
won their battles had their officers been subjected to the same kind of
treatment as LtCol Chessani.<br />
<br />
LtCol Chessani had served 3 tours of duty in Iraq and was considered
one of America’s most effective combat commanders.&#160; Chessani, a deeply
religious man who read his Bible every morning and evening while in
Iraq, stoically listened to the government lawyer’s demeaning remarks,
while his wife, pregnant with their seventh child, sat behind him
reading her Bible. <br />
<br />
Richard Thompson, President of the Thomas More Law Center commented:
“What has happened to LtCol Chessani is a good argument to get rid of
lawyers in the combat arms.&#160; Combat troops don’t need pencil pushers
second guessing commanders and troops in the field, long after an
event, in their air-condition offices.&#160; The fact that this hearing is
even taking place does a grave injustice, not only to Chessani and his
family, but to America.&#160; LtCol Chessani should be leading his troops,
not defending himself in a courtroom.” <br />
<br />
LtCol Paul Atterbury, 
the government prosecutor (called “Recorders” at a Board of Inquiry) presented the opening statement for the government, 
claiming there was no firefight.&#160; He claimed that the Marines faced a phantom menace, 
and LtCol Chessani did not properly investigate and report the overreaction of his Marines.&#160; <br />
<br />
LtCol Jon Shelburne, one of Chessani’s defense lawyers, countered that
Marines were ambushed in this daylong battle and were engaged in a
protracted pitched fight against well-armed insurgents.&#160; LtCol
Shelburne further stated that LtCol Chessani reported all he knew of
the battle, as he knew it, up the chain of command.<br />
<br />
The differences between the Board of Inquiry and the previous court
martial quickly became evident.&#160; Col Kurt Brubaker, USMC, the legal
advisor to the Board of Inquiry, is tasked with ruling on all
objections.&#160; Even though photographs of dead Iraqis would not have been
allowed into evidence at the previous criminal trial because they were
unduly prejudicial and had little relevance, particularly since LtCol
Chessani never saw them, the legal advisor will allow the government to
show them to the hearing panel because the rules of evidence to not
apply.<br />
<br />
Moreover, defense attempts to disqualify Brig. Gen. Lewis Craparotta,
the President and senior member of the Board, who during pre-hearing
questioning expressed a personal view that investigating every civilian
death is the right approach because “that’s the way to protect Marines,
” also failed.&#160; Defense attorney LtCol Shelburne had challenged the
fact that he was sitting on the Board of Inquiry with a pre-existing
opinion of what to do in a similar situation as LtCol Chessani.&#160; The
Board’s legal advisor rehabilitated Craparotta by personally
questioning him to show he could set aside his opinion, and then ruled
he could stay on the panel.<br />
<br />
The legal advisor, however, did prevent the introduction of the former
Article 32 hearing report on the grounds that its conclusions went to
the ultimate issue that the board members were required to decide
independently.<br />
<br />
A Board of Inquiry is an administrative board where the rules of
evidence do not apply.&#160; Evidence that would likely be thrown out in a
criminal proceeding may be considered by the Board.&#160; The government’s
burden of proof is lessened.&#160; Rather than having to prove its case
beyond a reasonable doubt, the government only has to prove
“misconduct” by a preponderance of evidence.&#160; <br />
<br />
If the Board finds “misconduct,
” then they will further determine whether LtCol Chessani should be
forced to retire or not.&#160; If the Board determines LtCol Chessani should
retire, then the Board must then make a recommendation to the Secretary
of the Navy as to whether he should retire as a Lieutenant Colonel, or
as a Major—a decision that could cost this Marine and his family over
four hundred thousand dollars in pay and benefits according to an
expert retained by the defense.&#160; <br />
<br />
The Thomas More Law Center, 
a national public interest law firm based in Ann Arbor, 
Michigan, 
has been defending LtCol Chessani at no charge.&#160; The Law Center’s attorneys, 
Robert Muise and Brian Rooney, 
both former Marine officers, 
have teamed up with the detailed military attorneys, 
LtCol Jon Shelburne, 
USMC, 
and Capt Jeffrey King, 
USMC.<br />
<br />
The dismissed criminal charges against LtCol Chessani were triggered by a heart-pounding house-to-house, 
room-by-room combat action taken by four Marines in his battalion after being ambushed by insurgents in Haditha, 
Iraq on November 19, 
2005.&#160; Along with several insurgents, 
15 civilians also died in this day long fight.&#160; The civilian casualties were tragic, 
but not uncommon in Iraq where insurgents would use them as shields. <br />
<br />
The “misconduct” allegations against LtCol Chessani are based on the
following: failing to properly report and investigate the November 19,
2005 incident.&#160; However, the indisputable evidence shows that LtCol
Chessani immediately reported the deaths of the 15 civilian Iraqis to
his superiors.&#160; <br />
<br />
Not one of his Marine superiors hearing of the civilian deaths ─
including top generals ─ considered it unusual.&#160; Not one ordered a
further investigation.&#160; Instead, they commended him for a job well
done.&#160; In fact, LtCol Chessani’s immediate superior told him that no
investigation was needed because it was a bona fide combat action—which
was consistent with the orders in effect at the time: no investigation
of civilian deaths related to combat action.&#160; That order was changed in
April, 2006, well after the Haditha incident.<br />
<br />
LtCol Chessani’s commanding general, Major General Huck, reported up
the chain of command, “I support our account and do not see the
necessity for further investigation.”&#160; This same commanding General was
allowed to retire without going to a Board of Inquiry, and he was
allowed to retire as a Major General.<br />
<br />
Consequently, 
not one of LtCol Chessani’s superiors faced, 
nor will they ever face, 
a court-martial or a Board of Inquiry for their actions in relation to November 19, 
2005.&#160; <br />
Of the eight Marines initially charged in the incident, 
six Marines, 
including Chessani, 
had criminal charges dismissed and one was acquitted.&#160; Only one Marine still faces criminal charges.<br />
<br />
Live testimony at the Board of Inquiry will begin on December 7, 
2009.&#160; <br />

<p><span style="font-size: small; font-family: tahoma"><a href="http://soldiersangels.org/index.php?page=project-valour-it" title="Project Valour-IT"><span style="color: #18507c">Project Valour-IT</span></a> began when Captain Charles &quot;Chuck&quot; Ziegenfuss was wounded by an IED while serving as commander of a tank company in Iraq in June 2005. </span></p>
<p><span style="font-size: small; font-family: tahoma">During his deployment he kept a blog (an online personal diary, opinion forum, or news analysis site-called a milblog or military weblog when written by a servicemember or about military subjects). Captivating writing, insightful stories of his experiences, and his self-deprecating humor won him many loyal readers. After he was wounded, his wife continued his blog, keeping his readers informed of his condition.</span></p>
<p><span style="font-size: small; font-family: tahoma">As he began to recover, CPT Ziegenfuss wanted to return to writing his blog, but serious hand injuries hampered his typing. When a loyal and generous reader gave him a copy of the Dragon Naturally Speaking Preferred software, other readers began to realize how important such software could be to CPT Ziegenfuss&#39; fellow wounded soldiers and started cast about for a way to get it to them. </span></p>
<p><span style="font-size: small; font-family: tahoma">A fellow blogger (blog author) who writes under the pseudonym FbL contacted Captain Ziegenfuss and the two realized they </span><span style="font-size: small; font-family: tahoma">shared a vision of providing laptops with voice-controlled software to wounded soldiers whose injuries</span><span style="font-size: small; font-family: tahoma"> prevented them from operating a standard computer. FbL contacted <a href="http://soldiersangels.org/" title="Home Page, shortcut key=1"><span style="color: #18507c">Soldiers Angels</span></a>, who offered to help develop the project, and Project Valour-IT was born. </span></p>
<p><span style="font-size: small; font-family: tahoma">In sharing their thoughts, CPT Ziegenfuss (now a Major) and FbL found that memories of their <a href="http://soldiersangels.org/index.php?page=about-sfc-william-v-ziegenfuss" title="About SFC William V Ziegenfuss"><span style="color: #18507c">respective</span></a> <a href="http://fuzzilicious.blogspot.com/2005/08/tale-of-two-fathers.html" target="_blank"><span style="color: #18507c">fathers</span></a> were a motivating factor in their work with the project. Both continue their association with this project in memory of the great men in their lives whose fine examples taught them lasting lessons of courage and generosity.</span></p>
<p><span style="font-size: small; font-family: tahoma">In the years since its founding in 2005, the project has acted to meet emerging needs and its mission of supporting the the severely wounded has expanded.&#160; In addition to voice-controlled laptops, Valour-IT now helps provide active and whole-body video games such as Wii Sports, which is used to great effect in physical therapy,&#160; and personal GPS systems that help compensate for short-term memory loss and organizational/spacial challenges common in those with brain injuries.</span></p>

<p><strong>Sgt. John M Penich, U.S. Army, was killed on October 16, 2008 while serving our country in Operation Enduring Freedom, Afghanistan. Sgt. Penich was assigned to Viper Company, 1st Battalion, 26th Infantry Regiment, 3rd Brigade Combat Team, 1st Infantry Division, as a light infantry rifleman. John had enlisted in the Army in March 2006 and was promoted to Sergeant in March 2008. </p><p><span style="FONT-SIZE: 1.25em">Sgt. Penich&#39;s awards include the Silver Star Medal, Bronze Star Medal with Valor, Bronze Star (Posthumous), Purple Heart Medal (Posthumous), the Army Commendation Medal, Army Achievement Medal (third award), Army Good Conduct Medal, the National Defense Service Medal, the Afghanistan Campaign Medal with Bronze Service Star, the NATO-ISAF Medal, the Global War on Terrorism Service Medal, the Overseas Service Ribbon, the Army Service Ribbon, the Army Parachutist Badge, the Expert Infantry Badge, and the Combat Infantry Badge. Sgt. Penich was also awarded the Brigade Soldier of the Year award in 2007. </p><p>He will be greatly missed by all those whose lives he enriched!! He was a devoted son, brother, uncle, friend, and soldier.</span></strong></p>

<p><span style="FONT-SIZE: 1.25em"><em>After witnessing the 2001 terror attacks, John M. Penich told his family he wanted to serve his country. But his career took a detour managing a hotel, a banquet hall and then a nightclub before enlisting. </em></span></p>
<p><span style="FONT-SIZE: 1.25em"><em>&quot;He kind of ignored his calling and bounced around,&quot; said his older brother Jeff Penich. &quot;But he had no regrets of joining the Army. It was a calling to him in 2001, and it didn&#39;t catch up with him until later.&quot; </em></span></p>
<p><em><span style="FONT-SIZE: 1.25em">Penich, 25, of Beach Park, Ill., died Oct. 16 in Karangol Village of wounds suffered from indirect fire. He was a 2001 high school graduate and was assigned to Fort Hood. </span></em></p>
<p><em><span style="FONT-SIZE: 1.25em">Penich enjoyed the outdoors, especially hunting, mountain biking, riding four-wheelers and Harleys, and playing paintball. </span></em></p>
<p><em><span style="FONT-SIZE: 1.25em">When sending care packages to him in Afghanistan, Jeff said his brother used to ask for things for his fellow soldiers. </span></em></p>
<p><em><span style="FONT-SIZE: 1.25em">&quot;It was never &#39;I would like this.&#39; Never, &#39;I want this.&#39; It was always, &#39;What can I get for my guys?&#39; He always put everyone before himself, including his country,&quot; Jeff said. </p></span></em></p>

<p>By Amanda Kim Stairrett Nov. 14, 2008<br /><a href="http://www.kdhnews.com/news/story.aspx?s=29302">Killeen Daily Herald</p></a>FORT HOOD – Kathleen Garross spoke to her son, John, several times over one week in mid-October.<br /><br />&quot;Did you get any new medals?&quot; she asked once.<br /><br />&quot;Yeah,&quot; her son answered. &quot;There should be a big one coming.&quot;<br /><br />&quot;What did you do to earn it?&quot; Garross asked.<br /><br />&quot;You don&#39;t want to know,&quot; was the response. &quot;Let me just tell you, I took care of business.&quot;<br /><br />Garross never got to hear from her son just what he did to earn a Silver Star, the third-highest honor given to service members for valor. Sgt. John Penich died Oct. 16 in Karangol Village, Afghanistan, of wounds suffered from indirect fire, according to information from the Defense Department.<br /><br />It wasn&#39;t until after his death that Garross learned of her son&#39;s heroics. They were heroics that earned him a Silver Star and a Bronze Star Medal with Valor. They were heroics that, on multiple occasions, led Penich to save the lives of his brothers in arms.<br /><br />Garross and Penich&#39;s father, James, received their son&#39;s Silver Star on Thursday following a memorial ceremony in his and three others&#39; honor.<br /><br /></p>

<p>&#160;Madam Speaker, I rise today to honor a brave American soldier who sacrificed his life for freedom, Sergeant John Penich. </p>Sergeant Penich, by all accounts, was an extraordinary solider whose hard work and determination earned him the title of Soldier of the Year in 2007 for his brigade. His bravery was evident in combat on several occasions. Brigadier General Perry Wiggins has said he knows of three separate instances when Sergeant Penich saved the lives of his comrades. <br /><br />According to newspaper reports, one of his final acts of bravery came on September 6, 2008, when his patrol was attacked by rocket-propelled grenades and small-arms fire. He showed his courage under fire, taking charge and reestablishing security and saving the lives of his platoon members. His heroics on that day earned him a Silver Star, the third highest honor given to members of the armed services for valor. <br /><br />Five and a half weeks after he earned the Silver Star, he gave the ultimate sacrifice. Sergeant Penich put himself in harm&#39;s way to make the world a better place. <br /><br />His commitment to this country is second to none. He wanted to be an officer, and there&#39;s no doubt we would have benefited from this young man&#39;s tremendous leadership abilities. <br /><br />Sergeant John Penich is a true American hero. <p>Sgt. John M. Penich, 25, assigned to the 1st Battalion, 26th Infantry, 3rd Brigade, 1st Infantry Division, Fort Hood, TX, &quot;Viper Company&quot;of the United States Army, from Beach Park, IL, was killed in action on October 16, 2008, while defending his country in Operation Enduring Freedom in Afghanistan. John was born January 6, 1983, in Waukegan, IL. He was a proud soldier and a loving and selfless man. John put everyone before himself. He was highly decorated, including Soldier of the Year 2007 3rd Brigade, 1st Infantry, Bronze Star with Valor and Single Oak Leaf Cluster, Combat Infantryman Badge, and had been recommended for the Silver Star.</p>

<p>Sgt. Penich lived his life to the fullest. He enjoyed hunting, traveling overseas, and taking motorcycle trips. He graduated with honors from Zion-Benton Township High School in 2001.</p><p>John is survived by his mother, Kathy (&quot;Dad&quot; Mike) Garross; father, James (Diane) Penich; brothers, Jimmy (Michelle) Penich and Jeff (Nicole) Penich; sister, Crystal (Pete) Barrett; grandparents, Donald (Pat) Weidner and Roger (Barbara) Garross; great-grandmother, Mary Hall; nieces and nephews, Autumn Long, Bryce and Eva Barrett, and Hailey and Hunter Penich; and the love of his life, Sarah Kelley; also surviving are other family, including, Jill Garross, Kim Zabresky, Kim (Chris) Van Beek, Clarissa Van Beek, Dan (Denise) Garross, Cassie and Chloe Garross, Denise (Dave) Balmes, Allie Balmes, Ray Caddell, Michael (Mary) Penich, Michael (Abbey) Penich, Tim Penich; dear friend, Mikey Kitch; and countless other friends and comrades.</p><p>He was preceded in death by grandparents, Elaine Weidner, Michael Penich Sr. and Jennie Penich; and great-grandparents, Katherine Garross and Ned Hall; and great-great-grandmother, Eva Gallup.</p>

Members of Congress and civilian bureaucrats that can&#39;t balance a
budget, spending America into eternal debt, participate in all sorts of
immoral behavior, fully corrupt, can&#39;t drive themselves from point A to
point B, speak at the level of 8 year olds, are only focused on a
personal self serving agenda, totally devoid of courage, integrity,
personal responsibility...in short are greedy cowards...with no
credible experience in national security and less than zero military
service, now want to second guess a seasoned military chain of command
in devising strategy and tactics in the Afghanistan war.
</p><p>
The political apparatus in Washington, DC has abandoned our troops in
harms way, indecision is allowing the enemy to refit their forces and
costing American lives, has sent a message of American political
weakness and surrender to the Islamic butchers, while giving scant
attention that our warriors are giving their lives and blood while
indecison reigns.
</p>
<p><strong>If Afghanistan is a &quot;war of necessity&quot; as the Commander In Chief
says, how can any level of leadership allow our men and women to be
without the resources to win??</strong>
</p><p>
Nothing is more despicable than sending men and women into war and then
betraying them while in battle...it would be entirely appropriate for
the military chain of command to withdraw all troops to safe areas,
expect a victory position within 72 hours from the Commander in Chief
with credible proof of resources to win, otherwise, the military chain
of command resigns.

<p><strong>Not one more drop of American blood spilled while Washington D.C. leadership cowers in surrender.</strong>

<p><span style="FONT-SIZE: 1.25em">Ryan Job, who grew up in Issaquah, Washington died Thursday morning, Sept. 24th&#160;after major reconstructive surgery at Maricopa Medical Center in Phoenix. He was 28.</span></p>

<p><span style="FONT-SIZE: 1.25em">A story on Ryan Job, a former (medically retired) Navy SEAL, <a href="http://seattletimes.nwsource.com/html/localnews/2008045927_rainier11m0.html">reaching the summit of Mount Rainier </a>appeared in July 2008. Three combat injured veterans - two blind, one missing his right leg - we are talking about superior performance! All three veterans: Ryan Job, Chad Jukes and Joey Martinez III summited Mt. Rainier. Less than 50% of all climbers make it to the summit of Mt. Rainier. Due to the extraordinary makeup of these vets and their climbing team, the group made the 8-hour grueling climb getting to the summit (14,410 feet). <p><span style="FONT-SIZE: 1.25em">Ryan Job underwent an eight-hour surgery Monday to rebuild his face and repair his eye socket. The recovery seemed to be proceeding smoothly, his mother said, though her son reported some discomfort Wednesday night. A nurse checked on him at 3:30 a.m. Thursday. He was found unresponsive at 5 a.m. She said the hospital had not determined the cause of death</span>.</p>
<p><span style="FONT-SIZE: 1.25em">&quot;It wasn&#39;t supposed to happen like this,&quot; said Debbie Job. &quot;It&#39;s a total shock.&quot;</span></p>
<p><span style="FONT-SIZE: 1.25em">Neighbors of the Job family on the Sammamish Plateau recalled Ryan Job as a strong, physically active young man who had been determined to join the elite Navy special-operations force, despite the grueling training regimen. Mr. Job regularly swam across Beaver Lake a few miles from his home and ran for hours before dawn, said Neil Iovino, a neighbor who watched the Job boys grow up.</span></p>

<p><span style="FONT-SIZE: 1.25em">Ryan Job was on patrol in Ramadi, Iraq, in 2006 when a sniper&#39;s bullet struck his rifle. <p><span style="FONT-SIZE: 1.25em">He and Kelly moved to Arizona in 2007 with the help of the Sentinels of Freedom Scholarship Foundation. The California-based organization assists armed-forces veterans severely injured in the line of duty on or after Sept. 11, 2001.</span></p>

<p style="TEXT-ALIGN: center"><span style="FONT-SIZE: smaller"></span><span style="FONT-SIZE: 1.25em">I believe that there are no coincidences in life. There are people and events that shape our lives and things are as they should be for a reason. Perhaps this is our destiny.&#160;There are people who come into our lives that change them forever. Their presence is powerful, it sends a ripple through us and all who we meet. Their names alone are enough to motivate us to set worthy goals and to press on to finish difficult tasks. Ryan Job is this person in my life. Ryan and I met this past summer, the meeting was totally &quot;by coincidence&quot;. In June a friend was in town visiting me from Boston. <strong>What are the odds that anyone would come visit me in Phoenix in the summer?</strong> </span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">He had never been to Phoenix before and he came to work with me to train a group of clients at 5:30 one morning. One of my clients later&#160;emailed to tell me that her friend trains with a former Navy SEAL named Ryan Job and wanted to know if my friend knew him.&#160;I asked Steve and he smiled wide and said yes, he and Ryan were good friends. This was in June 2008, my friend Steven had not seen Ryan since BUDS training back in 2003. <strong>What are the odds?</strong></span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">Ryan and I met and began training together to prepare him for his goal; the ascent of the 14, 411 foot&#160; Mount Rainier. <strong>What are the odds that a blind guy would be able to climb a mountain?</strong></span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">&#160;Early each Saturday morning we put on our Heart Rate Monitors and hiked together on the various peaks that surround Phoenix. He would lead, I would call out directions from behind with my hand on his shoulder. We would pass young able bodied people all the way to the top where we would turn around to descend now&#160;facing the people that we had passed.</span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">On the way up many were curious why I had my hand on his shoulder telling him where and how to step, now seeing Ryan they realized from his scare and closed eyes that he is blind. <strong>What are the odds that blind guy would pass you hiking?</strong></span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">On one occasion the people that we passed stood aside to let us come down and then without any warning or a single word, they broke out into spontaneous applause. Ryan asked me what was going on. I did not want a Navy SEAL to know that I was crying so I muttered, &quot;keep going, I will tell you later&quot;. Tears streamed down my face as I walked behind him thinking; who is leading who?</span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">My favorite book in the Bible is the Book of Job. It&#39;s about a man who has lost everything and finds the courage to walk by faith not by sight. <strong>What are the odds that now a blind man named Job was walking in front of me leading me&#160;by his faith not by sight?</strong></span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">Many who pray, including me, often request a sign or a clue&#160;that they are doing in life what they should be doing. Apparently, God knows that I sometimes miss his subtle suggestions, so he found a blind guy named Job&#160;to lead me early one morning on a desert trail&#160;then gathered a group of total strangers together to clap loudly as we passed by so that&#160;I would not miss&#160;his clue. (Thanks for tip, I got it).</span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">On July 10, 2008, a little less than two years after Navy SEAL Ryan Job cheated death on a rooftop in Iraq, he stood atop the roof of Mount Rainier (</span><a href="http://seattletimes.nwsource.com/html/localnews/2008045927_rainier11m0.html"><span style="COLOR: #0000ff"><span style="FONT-SIZE: 1.25em">See Seattle Times Story</span></span></a><span style="FONT-SIZE: 1.25em">). As he did two F-15 jets flew over him to salute his achievement. <strong>What are the odds?</strong></span></p>
<p style="TEXT-ALIGN: left"><span style="FONT-SIZE: 1.25em">Ryan has gone on to challenge himself in other areas of life, he creates his own opportunities because he works hard at everything he does. We are all very grateful for Ryan&#39;s and for his fellow veterans service to our country. The date was June 28, 2005. He was killed when his MH-47D helicopter was shot down by enemy fire on it&#39;s way to rescue a Navy SEAL team that had run in to trouble. He was a member of the Army 160th Special Operations Aviation Regiment (SOAR).</span></strong></p>

<p><span style="FONT-STYLE: italic"><span style="FONT-SIZE: 1.25em; COLOR: #990000">Tre was in Afghanistan only to train his fellow soldiers, not to fly. But flying was him and when the opportunity arose for him to be on an aircraft and the QRF (the quick reactionary force), he jumped at the chance. His aircraft dropped off a SEAL team on the mountain and as always, promised those men that if they needed him, he would be there. And so when on June 28, 2005 there was a call for help Tre and his men quickly and without hesitation answered the call. That would be his last earthly mission....his helicopter was shot down by a RPG and all on board were killed. The hero that called for help was Lt. Mike Murphy...a soldier that was honored in the </span><a href="http://wwp.kintera.org/faf/home/ccp.asp?ievent=276935&amp;lis=1&amp;kntae276935=987CC077FA6A4B319039B5BBA5FEF00D&amp;ccp=82271"><span style="FONT-SIZE: 1.25em; COLOR: #990000">Empire State Challenge</span></a><span style="FONT-SIZE: 1.25em; COLOR: #990000">.</span></span></p><p><span style="FONT-STYLE: italic"><span style="FONT-SIZE: 1.25em; COLOR: #990000">

<p><strong><span style="FONT-SIZE: 1.25em">Tre was born in Alabama on June 24, 1969 and he grew up in Franklin, TN. He graduated from Battle Ground Academy in 1987 and attended Auburn University. He married Leslie Miller in 1994, they were married in Franklin. Tre was a CH-47 Chinook crew chief and was accepted into 160 Special Operation Aviation Regiment in 1992, and stationed at Ft. Campbell, KY. He held various positions within the Regiment.</span></strong></p>
<p><span style="FONT-SIZE: 1.25em"><strong>Tre was the proud father of Samantha (born 1997) and Elizabeth (born 1999)...Tre worshipped his girls. He called them and his wife &quot;his three crazy girlz&quot;. <p>A Hunter Army Airfield hangar has a new name honoring the memory of an eight-person Night Stalker crew [including MSG James &quot;Tre&quot; Ponder] who died in combat on June 28, 2005. The 3rd Battalion, 160th Special Operations Aviation Regiment (Airborne) hangar, formerly known as Building 7902, is now named &#39;Turbine 33&#39; after the aircraft crew&#39;s call sign. <p><span style="font-size: medium; FONT-SIZE: 1em">Known as the Night Stalkers, the 160th is an elite aviation unit deployed in nearly every conflict since Grenada in 1983 to transport Special Forces units around the world by night in specially modified helicopters. It specializes in flying over water and developed many flying techniques now standard to Army aviators.</span></p>
